1. Introduction

Welcome to North Continuum. These Terms of Service ("Terms") govern your access to and use of our game server services for Dual Universe. By accessing or using our services, you agree to be bound by these Terms.

Important: North Continuum is an independent service provider and is not affiliated with, endorsed by, or connected to NovaquArk, the developer of Dual Universe. We provide server hosting and related services for players of Dual Universe.

2. Service Description

North Continuum provides game server hosting and player account management services for Dual Universe. Our services include access to game servers, player account management, market browsing, community features, and related services. All player accounts are completely free - there are no subscriptions or fees required to play.

We operate on a voluntary donation model. While all services are free to use, we accept voluntary donations to help cover server infrastructure, maintenance, and operational costs. Donations are entirely optional and do not affect your access to any features or services.

3. Account Registration and Eligibility

To use our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Free Service: All player accounts are provided completely free of charge. There are no subscriptions, fees, or payments required to create or maintain player accounts.

4. Voluntary Donations

North Continuum operates on a voluntary donation model. While all services are free, we accept voluntary donations to help cover server infrastructure, maintenance, and operational costs.

4.1 Donation Nature

Donations are entirely optional and voluntary. Donating does not grant any special privileges, access, or benefits beyond what is available to all users. All features and services remain free regardless of donation status.

4.2 Donation Processing

Donations are processed through secure payment processors. We accept various payment methods as indicated during the donation process. All donations are final and non-refundable.

4.3 Use of Donations

100% of donations are used exclusively for server infrastructure, maintenance, operational costs, and service improvements. We operate transparently with full financial visibility to our community.

4.4 Digital Wallet System

Donations may be stored in a digital wallet system that allows you to manage donation credits. Wallet credits can be used for future donations or transferred to other users as gifts. Wallet credits have no cash value and cannot be refunded or exchanged for money.

5. Discord Integration

North Continuum offers optional Discord integration to enhance your experience and connect with our community.

5.1 Discord Connection

You may optionally connect your Discord account to your North Continuum account. Discord connection is entirely voluntary and not required to use our services. Connecting your Discord account allows you to:

• Use Discord for authentication and login
• Sync badges and achievements to your Discord profile
• Participate in Discord-based community features

5.2 Discord Data Usage

When you connect your Discord account, we may access and store your Discord ID, username, and avatar for account linking and badge synchronization purposes. We do not share your Discord information with third parties, and we do not post your Discord username or private data to public Discord channels.

5.3 Game Data Posted to Discord

Certain game-related content (such as community ideas, feature announcements, and server updates) may be automatically posted to our Discord channels. No usernames, player names, or private data are included in these posts. Only public, non-identifying game content is shared to Discord for community engagement purposes.

5.4 Disconnecting Discord

You may disconnect your Discord account at any time through your account settings. Disconnecting will not affect your access to our services, though Discord-specific features will no longer be available.

6. Public Market and Privacy

North Continuum provides public market browsing features where players can view market orders and trading activity.

6.1 Market Visibility

By default, player names associated with market orders are visible in public market listings. This allows the community to see who is trading what items, fostering transparency and trust in the marketplace.

6.2 Market Anonymization

You have the option to anonymize your player name in public market orders. When enabled, your player name will appear as "Anonymous" in all public market listings, while you can still see your own name in your private account view. This feature allows you to maintain privacy while participating in the marketplace.

6.3 Anonymization Settings

You can enable or disable market anonymization at any time through your player account settings. Changes to this setting will apply to all future market orders. Past orders may continue to display your name if they were created before anonymization was enabled.

7. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Infringing on the intellectual property rights of others
• Transmitting any harmful, offensive, or inappropriate content
• Attempting to gain unauthorized access to our systems or other users' accounts
• Interfering with or disrupting the services or servers
• Using automated systems or bots to access the services
• Engaging in any fraudulent activities or payment disputes
• Abusing the donation system or attempting to exploit any features

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

8. Service Availability and Modifications

We strive to provide reliable and continuous service, but we do not guarantee that our services will be uninterrupted or error-free. We may modify, suspend, or discontinue any aspect of our services at any time without prior notice.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the services after changes are posted constitutes acceptance of the modified Terms.

9. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by North Continuum or its licensors and are protected by intellectual property laws.

Dual Universe and related trademarks are the property of NovaquArk. We do not claim any ownership or affiliation with NovaquArk or Dual Universe.

10. Limitation of Liability

To the maximum extent permitted by law, North Continuum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless North Continuum and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the services shall be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

14. Termination

We reserve the right to suspend or terminate your account and access to the services at any time, with or without cause, and with or without notice, for any reason including violation of these Terms.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
