1. Introduction

Welcome to North Continuum. These Terms of Service ("Terms") govern your access to and use of our game server services for Dual Universe. By accessing or using our services, you agree to be bound by these Terms.

Important: North Continuum is an independent service provider and is not affiliated with, endorsed by, or connected to NovaquArk, the developer of Dual Universe. We provide server hosting and related services for players of Dual Universe.

2. Service Description

North Continuum provides game server hosting and player account management services for Dual Universe. Our services include access to game servers, player account management, subscription management, and related features.

3. Account Registration and Eligibility

To use our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription Plans and Pricing

4.1 Main Account Subscription

Main account subscriptions are priced at $5.00 USD per month.

New User Promotion: Verified new users receive their first month free when creating their first main account. This promotion applies only to the first main account created by a new user.

4.2 Alt Account Subscription

Alt accounts (additional player accounts beyond your main account) follow a progressive pricing structure based on the account's age:

• Months 1-3: $1.00 USD per month
• Months 4-6: $3.00 USD per month
• Month 7 and beyond: $5.00 USD per month

Note: Alt accounts do not receive the first month free promotion. The progressive pricing begins immediately upon account creation.

4.3 Billing and Payment

Subscriptions are billed on a monthly basis. Payment is due at the beginning of each billing cycle. We accept various payment methods as indicated during the checkout process.

You authorize us to charge your selected payment method for all subscription fees. If automatic payment fails, your subscription may be suspended or terminated.

5. Refund Policy

All subscription payments are non-refundable. This includes but is not limited to:

• Monthly subscription fees for main accounts
• Monthly subscription fees for alt accounts
• Wallet recharges and credits
• Any other payments made for services

By subscribing to our services, you acknowledge and agree that all payments are final and non-refundable, regardless of usage or cancellation timing.

Revenue Usage: All income generated from subscriptions is used exclusively for server infrastructure, maintenance, and operational costs to provide quality service to our community.

6. Subscription Cancellation and Alt Account Restrictions

6.1 Cancellation Process

You may cancel your subscription at any time through your account dashboard. Cancellation will take effect at the end of your current billing period. You will retain access to services until the end of the paid period.

6.2 Alt Account Cancellation Policy

Important: If you cancel an alt account subscription, you will be restricted from creating a new alt account for 90 days from the date of cancellation.

This 90-day restriction is designed to prevent abuse of the progressive pricing structure for alt accounts. The restriction applies regardless of whether you maintain other active accounts.

After the 90-day restriction period expires, you may create a new alt account, which will begin at the Month 1 pricing tier ($1.00 USD per month).

7. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Infringing on the intellectual property rights of others
• Transmitting any harmful, offensive, or inappropriate content
• Attempting to gain unauthorized access to our systems or other users' accounts
• Interfering with or disrupting the services or servers
• Using automated systems or bots to access the services
• Engaging in any fraudulent activities or payment disputes
• Abusing the subscription system or pricing structures

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

8. Service Availability and Modifications

We strive to provide reliable and continuous service, but we do not guarantee that our services will be uninterrupted or error-free. We may modify, suspend, or discontinue any aspect of our services at any time without prior notice.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the services after changes are posted constitutes acceptance of the modified Terms.

9. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by North Continuum or its licensors and are protected by intellectual property laws.

Dual Universe and related trademarks are the property of NovaquArk. We do not claim any ownership or affiliation with NovaquArk or Dual Universe.

10. Limitation of Liability

To the maximum extent permitted by law, North Continuum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless North Continuum and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the services shall be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

14. Termination

We reserve the right to suspend or terminate your account and access to the services at any time, with or without cause, and with or without notice, for any reason including violation of these Terms.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
